1. THE LAW
OMENI' guarantees the right of withdrawal as established by Legislative Decree no. 206 of 6 September 2005 with the subject "Consumer Code pursuant to art. 7 of Law 29 July 2003 No. 229", amended by Legislative Decree no. 21 of 21 February 2014, Article 1 .
Our customers who place orders through the website www.heemia.com have the right to withdraw, without any penalty and without specifying the reason, within fourteen (14) working days.
They run:
a) for goods, from the day of their receipt by the consumer
b) for services (e.g. for purchase vouchers), from the day of conclusion of the contract, or from the finalization and sending of the order to our systems and subsequent digital delivery of the service.
2. REQUEST FOR WITHDRAWAL
The right of withdrawal is exercised by requesting via email, writing to the address omeni.lab@gmail.com
3. NECESSARY CONDITIONS
a) The withdrawal request must be sent within the terms established in point “1. The law” and in the manner indicated in point “2. Withdrawal request”
b) The products must not have been used, worn, washed or damaged
c) The products are delivered to the customer with an identification and disposable tag: it must still be present, well preserved and, in the case of disposable seals, attached in the original position.
d) The products must be returned in their original packaging, if it is disposable it must not have been opened and must still be well sealed. The items must still have all the original labels, packaging and accessories (Dustbags, hangers, garment covers etc.) received with the order.
e) Swimwear and underwear (bikinis, briefs, boxers etc.) can be tried on by the customer over their own underwear. Returns of these items will not be accepted if the transparent hygienic protection label has been removed, or if the items show signs of use.
f) The return must be made in a single solution, after authorization/acceptance by the seller and through the courier indicated by customer service. The customer will receive an email that will start the return procedure and will indicate the authorization reference. This email must be printed and inserted inside the package.
g) Shipping costs in Italy including islands for the return of the goods will not be borne by OMENI' in the event of a refund . For returns from abroad, the cost of the return may vary based on the country of origin, ranging between €20 and €50: the customer will be informed by our customer service about the cost to be paid when the authorization is sent. Customs duties are borne by the customer.
h) The cost of shipping from abroad will be deducted from the refund that heemia will make and will be invoiced to the customer.
i) Returned products must be delivered to the courier within fourteen (14) days from the date on which the customer received the return acceptance email.
l) The seller has the right not to accept the return of products that do not comply with the characteristics and requirements listed here or in the event that the return procedure has been carried out without following the instructions in this paragraph.
4. REFUND TIMES
OMENI' will refund the purchase as soon as possible, and in any case no later than fourteen (14) days from the date on which OMENI' receives the goods sold or until the consumer has demonstrated that they have been sent back.
Once OMENI' has received the return and checked that all the requirements have been met, the customer will receive an email confirming acceptance and will send the courier ( at OMENI's expense in the case of the first exchange ) to collect the item. In the case of a refund, the shipping costs will be deducted.
5. REFUND METHOD
The customer can choose between two different ways to conclude the withdrawal procedure:
a) Value voucher: the customer will be sent a discount code that will correspond to the value of the return net of shipping costs.
This code can be used within 90 days from the moment of issue: it cannot be combined with other discount coupon codes or gift voucher codes.
The value must be used in a single solution for an order that has a value equal to or greater than the refund.
b) Refund of payment: for orders paid with Paypal or Credit Card, the refund usually occurs within 24/48 hours of acceptance and on the account/credit card from which the payment originated, however it may take several days for the buyer to receive the reversal/refund from Paypal or the Credit Card.
In the case of payment by bank transfer, the amount will be returned to the original account by bank transfer: times may vary from bank to bank and it may take up to 5-6 working days from the time the refund is sent for the value to be credited to the customer's current account.
In the case of payment by cash on delivery, the refund will be made by Paypal and the cash on delivery and shipping costs will be retained.
6. RETURN FOR DEFECTIVE OR WRONG PRODUCT
If the customer receives a product that does not comply with the order or is defective/damaged, the costs of returning the goods will be borne by OMENI'
If the case should arise in which the product requested in the order that received the wrong delivery is no longer available, OMENI' will offer the customer the refund methods illustrated in point “4. Refund method”.
OMENI' will not be responsible in any way and will not follow up on requests for compensation that are greater than the amount of the incorrect order net of shipping costs.
OMENI' reserves the right to request photographic evidence before authorizing returns for defective goods and to cover the shipping costs for returning the goods to the warehouses.
